Grandparents are to be given legal rights to maintain contact with their grandchildren after a family breakdown or divorce.
A report will today set out radical proposals to enshrine in law greater access rights for grandparents when couples split, Whitehall sources revealed.The review of the family justice system will also mean couples being pushed into mediation to sort out contact arrangements rather than resorting to the courts.

The report, by former civil servant and businessman David Norgrove, will herald the biggest shake-up in family law for decades.
Ministers say it is a scandal there is ‘little or no’ recognition of the vital role grandparents play in society.
Research suggests they are increasingly relied upon by parents for help with childcare and family finances, and by older children for advice and support that they may not get from their parents. But currently, they have no rights to maintain contact with grandchildren after a parental split.
Almost half face the heartbreak of being cut off completely and never see their grandchildren again after a break-up, with those whose sons are involved in a separation faring worst.

That means grandparents have to apply to the courts even to be given permission to make a request for some sort of contact, a lengthy and expensive process.
But today’s report will recommend enshrining in law greater rights to access when couples separate.
‘It will mean putting into law a recognition for grandparents and the important role they can play in supporting children who are involved in bitter custody disputes,’ said one source close to the reforms.
‘If they are denied access to their grandchildren who goes off with one parent, they should be able to appeal against that and take it to court.
‘It is a new legal right recognising that they should be able to maintain contact with their grandchildren.’
A new right for grandparents to apply for contact may raise concerns that access agreements will become over-complicated – for instance, if a mother has to agree to maintain contact with both an ex-husband and his parents.
But courts are expected to be allowed to continue to decide what is in a child’s best interests.
The plan will be welcomed by campaigners for grandparents’ rights, who have been arguing for years that their role in creating strong families should be better recognised.
The source said ministers would also consider giving grandparents greater custody rights if their grandchildren are being threatened by local councils with being fostered or taken into care.
City of Edinburgh Council acted despite the fact the grandparents had been caring for the boy and girl while their own daughter battled a heroin addiction.
The move sparked a backlash from the public, politicians and church leaders, who accused social work bosses of ‘politically correct’ posturing.
Grandparents provide over 40 per cent of childcare for parents who are at work or studying and over 70 per cent of childcare at other times. The contribution that grandparents make would cost parents an estimated £3.9billion a year.

And some 27 per cent of children aged 11 to 16 say they can share things with grandparents which they cannot talk to their parents about, rising to 35 per cent for their maternal grandmother.
Research also suggests a strong link between involvement of grandparents and wellbeing of children, teenagers in particular.
Today’s report is also expected to propose greater support for separating parents to enable them to manage conflict between themselves and to agree and maintain enduring contact arrangements.
This will require a significant shift away from adversarial court cases towards ‘non-legal interventions’ such as attendance at a Separated Parenting Information Programme – a course that helps separating parents understand what effect the process has on their children and how to proceed more effectively – or use of mediation.
The report is also expected to reject the idea of a new legal presumption of a child spending near equal amounts of time with each parent after separation.
A spokesman for single-parent charity Gingerbread said: ‘Our members tell us that court proceedings are long, difficult and expensive.
‘The majority of parents will do their best to avoid going to court but often struggle to know where to go for help and information about alternatives. This will require significant financial investment to ensure services are available throughout the country.’
The rights of grandchildren were not historically dealt with in law because divorce was relatively rare.
But the rise of family breakdown in recent decades means that access rights – for parents and grandparents – have become a pressing social issue.
It is thought that the rights for grandparents would apply both after a divorce – following marriage – and a separation where an unmarried couple have been co-habiting.

We are used to seeing her step out in figure hugging leotards, colour-clashing corsets and mismatching ensembles so when Nicki Minaj arrived at an event in New York last night it appeared she had opted to play it safe with a plain all-black black outfit.
But upon closer inspection it became clear she was dressed in one of her more bizarre and highly-unflattering ensembles to date.
The 26-year-old rapper arrived at the Green Auction event held at the Rockefeller Centre in New York last night in a tight black leather cat suit with black leggings and heeled boots.

But while the view from the front was aesthetically pleasing from the back it was a very different style story and the high legged leotard did nothing to flatter her plentiful derriere.
In fact it was apparent the leotard was extremely ill fitting around her bottom and her back.
But badly fitting clothing didn’t stop Nicki from taking to the stage to perform at the Christie’s Green Auction: Bid to Save The Earth event in New York.

Police believe that the young girl and a shopkeeper were caught in the crossfire of a gang targeting two youths who sheltered in their shop.
The shopkeeper, 35, is also being treated in hospital after he was hit inside Stockwell Food & Wine shop, on Stockwell Road, South London, at 9.15pm last night.
Both of the victims are understood to be Sri Lankan, but they are not related. The young girl was shot in the chest and the man was shot in the face.

The parade of shops was cordoned off today and five police cars were parked outside.
A Metropolitan Police spokesman said: 'It is believed two black youths ran into the shop shortly before the shots were fired.
'The youths had been chased from Broomgrove Road, across Stockwell Road, and into the shop by three other black youths on bicycles.
'Once the youths on bikes were outside the shop, one of them fired shots into the shop front.'
The pair - who police said are not related - were taken by ambulance to a nearby hospital. Detectives are continuing their hunt for the gunman.
Sandra Rossetto, 45, said the child was awake as ambulance crew tried to stabilise her. She said: 'One of the paramedics was stroking her forehead over and over. She was awake.
'They were pushing on her chest for about 10 minutes trying to stop the bleeding. There were a lot of people so they put up two red blankets either side to shield her.
'The other person was on the floor being treated. There was a lot of blood, you could tell it was serious.'
Gloria Richards, whose flat overlooks the shop, said: 'It's madness. It could have been my granddaughter. I do hope they catch them.
'I looked over my balcony last night and saw police, forensics, ambulances, everything. They had red screens up so you couldn't see. The police were in the shop all night.'
Mareh Silva, 34, was coming out of the convenience store with friends at around 9pm and said she saw three black youths aged between 14 and 17 drop their bikes outside.
She said the boys' faces were covered with black scarves and balaclavas and she could only see their eyes as they ran into the shop.
'I looked in and saw a lot of blood on the floor but I didn't want to look at what had happened and I was very scared,' she said.
Detective Chief Inspector Tony Boughton said: 'This is a terrible incident where an innocent child has been seriously injured.
'We want to hear from the local community, who might have seen these youths cycling around the estate between 9pm and 10pm
'I appeal to those who have information or were involved in this shooting to come forward and assist us with this investigation.
'These criminals have seriously injured two innocent bystanders and must face the consequences of their actions.'
Peter Robbins, one of three Lambeth councillors who represent the area, said local people were numbed by the incident.
'It is incredibly shocking, I think the whole community at the moment is numb and horrified, and rightly so,' he said.
'There is a fairly well-known problem with gangs and guns in Lambeth, it is something that the council and the police are working together incredibly hard to solve.

The mother may have been the Queen and her son the heir to the throne, but the pride is that of any first time parent.In a handwritten letter sent two weeks after the birth of Prince Charles in 1948, Queen Elizabeth II shows rare emotion, describing her new arrival as 'very sweet'.
The letter, addressed to her second cousin, Lady Mary Cambridge, is one of two being sold at auction this Saturday.

The birth of Charles, a future king, shortly after the end of the Second World War was a great boost for the country.
And the monarch herself was clearly delighted, but stated: 'I had no idea that one could be kept so busy in bed - there seems to be something happening all the time!'

The Queen stated she was also grateful that she had a nanny, adding that they were 'so difficult to find nowadays!'
She also thanked her second cousin - who was bridesmaid at her wedding to Prince Philip in 1947 - for her 'letter of congratulations and lovely present.'
The letter is signed 'Lillibet', the name she was called by her close family, and dated December 1, 1948, just two weeks after giving birth at Buckingham Palace.
The letter is now being sold at auction along with another from the Queen to the same recipient following the birth of Prince Andrew in 1960.
Of her second son the Queen wrote: 'The baby is adorable, and is very good, and putting on weight well.
'Both the older children are completely riveted by him, and all in all, he's going to be terribly spoilt by all of us, I'm sure!'
Richard Davie, from International Autograph Auctions, is selling the letters that have been consigned for auction by private collectors.
He said: 'Rarely does the Queen convey such emotion to the population so it is fascinating to read about her feelings.
'It is especially interesting to hear her write about her children and how proud she was.
'Prince Charles is described as "sweet" and Prince Andrew is "adorable".
'The birth of Prince Charles was of course hugely important in the context of the future of the monarchy.
'But his arrival prompts the same maternal reaction in the Queen as with any other new mum.'
The Prince Charles letter is expected to make up to £1,200 and the Prince Andrew letter £800 when they go under the hammer this Saturday.
With the Royal wedding between Prince William and Kate Middleton coming up there is a renewed interest in Royal memorabilia.

Marriage levels have fallen to their lowest level since 1895, according to new figures.
The provisional number registered in England and Wales in 2009 was 231,490.
Across the UK, the provisional level is 266,950 - almost half the peak figure of 480,285 in 1972.
In Scotland, levels are down 4.8 per cent on 2008 and 6.8 per cent lower in Northern Ireland.
For England and Wales, the number of unmarried adults rose producing the lowest marriage rates since they were first calculated in 1962.
The provisional marriage rate for men aged 16 and over was 21.3 per 1,000, down from 22 in 2008. For women, it was 19.2 - down from 19.9.

They are to have a 'small ceremony' at Langar Hall hotel near Nottingham, close to where Miss Thornton grew up and a favourite with designer Paul Smith and Cliff Richard.
His brother David and his wife Louise will be among around 50 guests at the wedding and Ed said there might be a 'low key' stag night beforehand.
They will then have a larger party in Doncaster, his constituency, after returning from honeymoon.
A daytime wedding for around 50 people at the hotel, which also hosted the marriages of actress Sarah Lancashire and footballer Michael Dawson, will cost the couple around £5,000.
Langar's regular wedding planner Pascal Bouyssounouse - dubbed Mr Cupid - will be taking charge.
'This is going to be a fantastic day for us both and I feel incredibly privileged to be marrying someone so beautiful and who is such a special person,' Ed said.
'It's the right time for us to do this and I'm really looking forward to a lovely day. We're going to have a party in Doncaster when we get back from honeymoon - which will be in an undisclosed location.
'At the end of the day we're in our 40s and we've got two kids - so it wasn't a case of me suddenly popping the question. This is just something we think is right for us.'

David Cameron offered his congratulations when he faced the Opposition leader across the Commons chamber at question time.
'On behalf of everyone in the House I can congratulate you and Justine on the happy news of your forthcoming wedding and, I am sure with everyone, to wish you a long and happy life together,' the Prime Minister said.
Unable to resist a dig at his adversary, he added: 'When I was leader of the opposition, I would have done anything to have a honeymoon. He probably feels the same way.'
Mr Miliband was teased about his marital status in an interview with Piers Morgan earlier this year and insisted he would only marry at the right time for him.
'The more people who challenge me on it from a political standpoint, the more resistant I will become,' he said.
'We'll get married because we want to get married and love each other very much, no other reason.
'Marriage is a good institution and part of having stable families, but there are also people in unmarried relationships with stable families. I don't think politicians should order people to get married.'
