The photographer launched a lawsuit against the singer in February, claiming the clip copied the 'composition, total concept, feel, tone, mood, theme, colours, props, settings, decors, wardrobe and lighting' of his work.
The case went to court yesterday in New York, where Judge Shira Scheindlin dismissed LaChapelle's claims of trade-dress infringement, unfair competition and unjust enrichment, but did acknowledge the similarities between Rihanna's video and his images and therfor allowed him to proceed with his allegation of copyright violation.

'Both works share the frantic and surreal mood of women dominating men in a hypersaturated, claustrophobic domestic space,' the Judge wrote in her decision.
'Thus, I find that an ordinary observer may well overlook any differences and regard the aesthetic appeal of Striped Face and the Pink Room Scene as the same.'
Representatives for Rihanna and LaChapelle are understood to be meeting next month to attempt to work out an agreement.
